What the Lawsuit Alleges

Plaintiffs — primarily minors and their families — allege that TikTok and parent company ByteDance knowingly engineered features including the algorithmic 'For You' feed, infinite scroll, and variable reward mechanics to maximize engagement among adolescents, despite internal awareness of mental-health risks. Cases allege resulting harms including clinical depression, anxiety, eating disorders, self-harm, and suicidal ideation. A parallel federal government lawsuit (DOJ/FTC, filed August 2024) separately accuses TikTok of violating the Children's Online Privacy Protection Act (COPPA) — that case is a regulatory enforcement action, not a consumer compensation claim.

U.S. District Court, Northern District of California — MDL No. 3047, In re Social Media Adolescent Addiction/Personal Injury Products Liability Litigation, before Judge Yvonne Gonzalez Rogers. A parallel California state proceeding (JCCP 5255) runs concurrently in Los Angeles.

Current Status

Active and growing. As of mid-2026, 2,664 individual cases are pending in MDL 3047. TikTok settled two individual bellwether cases — the K.G.M. case (January 2026) and the Breathitt County School District case (May 2026) — on confidential terms with no admission of liability; these do not resolve or pay any other pending claim. The first federal MDL school-district bellwether trial opened in June 2026. Attorneys general from 41+ states have filed separate enforcement actions. The older $92 million BIPA/privacy class-action settlement was approved in July 2022 and its claims period is closed.

Who Is Affected & Can You Join?

You may be eligible to file an individual lawsuit (not a class action) if: (1) you used TikTok regularly before age 18; (2) you developed a documented, diagnosed mental-health condition — such as depression, anxiety, an eating disorder, or engaged in self-harm or suicidal ideation — that a licensed provider can substantiate; and (3) your injuries warrant individual litigation. Adults harmed solely as adults are currently excluded from the individual MDL track. Statutes of limitations vary by state, so consult an attorney promptly. There is no open class-action claim form or settlement fund.

Is There a Payout?

No global TikTok settlement fund exists. The two resolved bellwether settlements were confidential. Published attorney estimates for individual claims — based on comparable litigation, not guaranteed amounts — range from roughly $30,000–$150,000 for moderate documented harms up to $300,000–$900,000 or more for severe eating disorders, self-harm, or wrongful death. These are projections, not announced payouts. Any website claiming you can fill out a form to receive a settlement check without attorney representation is misleading; this litigation requires individual case evaluation.

    Federal courts consolidated thousands of social-media addiction lawsuits into MDL 3047 in the Northern District of California before Judge Yvonne Gonzalez Rogers, with TikTok/ByteDance named alongside Meta, Snap, and Google.

    January 2026 — TikTok Settles K.G.M. Bellwether

    On the day jury selection began in the first California state-court bellwether trial, TikTok reached a confidential settlement. Terms were not disclosed and TikTok admitted no liability. The settlement resolved only that one case.

    March 25, 2026 — First Jury Verdict ($6M)

    In the K.G.M. trial TikTok had exited, a Los Angeles jury awarded $6 million against Meta and Google — the first jury verdict on social-media product-liability claims.

    May 2026 — TikTok Settles School-District Case

    ByteDance (TikTok), with Snap and Google, settled with the Breathitt County School District (Kentucky) on confidential terms days before the first federal MDL school-district bellwether trial.

    The first federal bellwether trial in MDL 3047 opened. With TikTok having settled, Meta was the primary defendant. Bellwether outcomes are expected to drive broader settlement negotiations across the 2,600+ pending cases.

No Open Claim Form Exists for TikTok

As of mid-2026 there is no class-action settlement fund, claims portal, or form the public can submit to receive a TikTok payout. Any site asking you to fill out a form to 'join the TikTok settlement' and get a check is a scam or a misleading lead-generation page. Legitimate participation requires retaining an attorney who files an individual lawsuit.

The $92 Million Privacy Settlement Is Closed

A separate $92 million settlement over TikTok's biometric and privacy practices was approved in July 2022 and its claims deadline has long passed. Any site advertising it as currently open is presenting outdated or false information.

Beware Impersonators Promising Specific Dollar Amounts

Because TikTok's actual bellwether settlements are confidential, no outsider knows the amounts paid. Scam sites and deceptive ads quote fabricated figures to harvest contact information. Legitimate attorneys evaluate your specific case and won't guarantee a fixed amount before reviewing records.
