Two consolidated class actions — Niemczyk v. Pro Custom Solar LLC and Hill et al. v. Pro Custom Solar LLC — alleged that Momentum Solar violated the federal Telephone Consumer Protection Act (TCPA) and related state telemarketing laws by placing automated telemarketing calls about solar services without prior consent. The class period spans March 5, 2015 through January 2, 2025. (Separately, the company has faced distinct employment-discrimination suits, which are not part of this TCPA settlement.)

Current Status

The settlement received final court approval on August 18, 2025. The claims submission deadline was July 31, 2025 — the window to file is now closed. Payouts to eligible claimants who filed valid claims are distributed as funds accumulate, beginning with an initial $1 million payment within 90 days of final approval. The settlement is structured over up to 15 years (or a QuickPay option of $20 million within 7 years), totaling up to $30 million.

Who Is Affected & Can You Join?

To have been eligible, an individual must have received two or more telemarketing calls from Momentum Solar (or on its behalf) within any 365-day period between March 5, 2015 and January 2, 2025, and must NOT have been a current or former Momentum Solar customer. The claims deadline of July 31, 2025 has passed; new claims are no longer accepted.

Is There a Payout?

Claimants could submit claims for up to 50 qualifying calls on a per-call, pro-rated basis. Based on roughly 10,000 expected valid claims, settlement documentation projected individual payouts of approximately $1,266 to $1,933 — though actual amounts depend on total valid claims filed. Payouts are not a lump sum; the defendant distributes funds over time under the structured schedule, beginning with $1 million in the first year.

    Thomas Niemczyk filed the first class action (Case No. 2:19-cv-07846) in the District of New Jersey, alleging Momentum Solar made unauthorized automated telemarketing calls in violation of the TCPA.

    A related TCPA class action, Hill et al. v. Pro Custom Solar LLC (Case No. 2:22-cv-00247), was filed and later consolidated with the Niemczyk case for settlement.

Scammers offer to 'expedite' settlement payments in exchange for personal or banking information. The official administrator contacts claimants by mail and the official website only — not unsolicited phone calls.

No attorney or third party was needed to file — the process was free and self-serve. Be wary of any service that charged a fee to submit a claim on your behalf.
